Parental leave by country / Luxembourg
Maternity, paternity and parental leave in Luxembourg
How long each parent can be away, who pays and how much, the notice rules and the job protection — in plain English, whether you run a team in Luxembourg or work on one.
Luxembourg gives mothers 20 weeks of maternity leave — eight before the birth and twelve after — paid by the Caisse nationale de santé. Fathers and partners have ten days of congé de naissance. Each parent then has a non-transferable parental leave of four or six months, or a part-time equivalent, paid as a replacement income by the Caisse pour l’avenir des enfants rather than as a flat allowance.

How it works
Maternity leave runs from eight weeks before the expected date to twelve weeks after the birth; the pre-natal portion that is not used because the birth comes early is not lost, and the post-natal period is extended for premature or multiple births. The CNS pays the maternity allowance on the same basis as sick pay, capped at five times the social minimum wage. Congé de naissance is ten days for the second parent, taken within two months of the birth. Parental leave is the distinctive part: each parent has their own non-transferable entitlement, taken as four months full-time, six months at half time, or split arrangements, and the first parent’s leave must follow maternity leave directly if it is to be taken at all. The Caisse pour l’avenir des enfants pays an income-replacement allowance between a floor and a ceiling tied to the social minimum wage, which makes Luxembourg parental leave substantially better paid than the flat-rate schemes in neighbouring countries.
Worth knowing: Luxembourg parental leave is paid as a proportion of previous earnings rather than a flat rate, and each parent’s entitlement is strictly non-transferable — if one parent does not take it, it is lost rather than passed on.
If you run a team in Luxembourg
You cannot refuse parental leave, only ask to postpone the six-month option in defined cases; notice is two months for the first parent and four for the second. Keep the post open — the employee returns to the same or an equivalent job and dismissal protection applies from notification of pregnancy through the leave. Annual leave keeps accruing, and leave that could not be taken because of maternity or parental leave is carried over.
If you work in Luxembourg
Send the medical certificate to your employer and the CNS twelve weeks before the due date. The second parent takes the ten days of congé de naissance within two months of the birth. For parental leave, decide early: the first parent’s leave must follow maternity leave immediately, and the request goes to the employer two months beforehand and to the Caisse pour l’avenir des enfants separately.
Parental leave and annual leave
Annual leave accrues in full during maternity leave and during parental leave, and days that could not be taken because of either are carried over beyond the usual 31 March limit.
The annual leave entitlement itself is covered on our Luxembourg annual leave page — 26 working days minimum.
Keeping the record straight
Long leaves are where leave records go wrong quietly: holiday that kept accruing for months and was never credited, a return date nobody diarised, a reduced entitlement applied where the law forbids it. In Luxembourg the rules above decide what is owed on return, and the record has to show it. A tracker like Leavo keeps the leave, the accrual and the approvals in one place so the return is a date, not a dispute. We compare the options in our leave management software guide, and the policy side — carryover, payout, accrual — in our guides.
Parental leave in Luxembourg: common questions
How long is maternity leave in Luxembourg?
Twenty weeks: eight before the expected date of birth and twelve after it, paid by the Caisse nationale de santé up to five times the social minimum wage.
Can parental leave be transferred between parents?
No. Each parent has their own entitlement of four or six months and it is lost if that parent does not take it. The first parent’s leave must also follow maternity leave directly.
Is parental leave well paid?
Comparatively, yes. The Caisse pour l’avenir des enfants pays an income-replacement allowance between a floor and a ceiling linked to the social minimum wage, rather than the flat monthly amounts used in France or Belgium.
Does annual leave accrue during maternity or parental leave in Luxembourg?
Annual leave accrues in full during maternity leave and during parental leave, and days that could not be taken because of either are carried over beyond the usual 31 March limit.
