Is PTO paid out in Tennessee?

Not automatically. Tennessee has no statute forcing PTO payout, so the employer written policy or contract controls. If that policy promises payout, the state will enforce it as a wage obligation.

What the Tennessee rule actually says

Tenn. Code § 50-2-103(a)(3) provides that an employer is not required to pay out accrued vacation at separation unless its policy or labor agreement specifically provides for it.

The practical consequence is that the handbook is the law here. If the written policy promises payout, Tennessee will enforce that promise as a wage obligation. If the employer wants forfeiture, the policy has to say so plainly and employees have to have received it. Silence tends to be read against the employer.

What this means if you are an employer in Tennessee

  • Put the rule in writing and date it. An undisclosed forfeiture rule is the single most common way employers lose these claims.
  • Track balances to the hour, with an audit trail. In a dispute the burden lands on the employer to show what was accrued, taken and approved.
  • Settle the balance in the final paycheck where payout is owed, not in a later off-cycle payment — late final wages carry their own penalties in most states.

What this means if you are an employee in Tennessee

  • Ask for the written PTO policy in force on your hire date and on your last day. Both matter.
  • Keep your own record of approved time off. Payroll systems get reconfigured; your notes do not.
  • If a balance you believe you earned is not on the final paycheck, the Tennessee labor agency takes wage claims directly — you do not need a lawyer to start one.

Does Tennessee require employers to pay out unused PTO when an employee quits?

Only if the employer's own written policy or contract promises it. Tennessee has no statute that independently creates the obligation, but a policy that promises payout is enforceable as a wage obligation.

Can a Tennessee employer use a "use it or lose it" PTO policy?

Generally yes, provided the policy is in writing and was communicated to employees in advance. A forfeiture rule that was never disclosed is difficult for an employer to enforce.

Is unused PTO taxed differently when it is paid out in Tennessee?

No. A PTO payout is supplemental wages. It is subject to normal income and payroll tax withholding, and the IRS permits a flat supplemental withholding rate, which is why a payout check often looks smaller than the employee expected.

What can an employee do if a Tennessee employer refuses to pay out PTO that is owed?
